GENERAL TERMS AND CONDITIONS
FOR GOOSE AG

  1. SCOPE

These general terms and conditions (T&Cs) apply for all legal relationships between Goose AG and purchasers of products or services from Goose AG, regardless of the method of ordering. Only individual agreements which are approved in writing shall take precedence over these general terms and conditions. Goose AG shall always publish the currently valid version of these T&Cs on the website and in the sales documents.

 

  1. CONCLUSION OF CONTRACT

The customer expressly accepts these T&Cs by placing an order.
The contract between Goose AG and the customer shall be concluded upon delivery of the order confirmation by Goose AG (in writing, over the phone, by email or in another manner).

The order confirmation shall set out binding quantities and prices and non-binding delivery dates.

 

  1. PROTECTION OF MINORS

The law prohibits the sale of wine, beer and cider to persons under the age of 16 and prohibits the sale of spirits, aperitifs and alcopops to persons under the age of 18.

By placing an order, the customer declares that they are at least 18 years of age.

 

  1. PRICES

The prices published in the current version of the price list and on the website at the time of receipt of the order shall always apply. The prices are per unit excluding VAT, deposit fees and transport costs in euros. VAT will be listed separately on the invoice. Goose AG reserves the right to change its prices at any time.

 

  1. PRODUCTS AND CHANGE OF VINTAGE

Offers shall apply for as long as the products are available. Goose AG shall not be obligated to procure specific products or vintages. Goose AG reserves the right to replace a sold out vintage with the following year’s vintage without notification.

  

  1. DELIVERIES AND RISK ASSUMPTION

Deliveries shall be made from stock.

The customer must ensure that Goose AG can make the delivery. The customer shall be liable for damages caused by difficulties during delivery which cannot be attributed to Goose AG (e.g. lack of access, if the customer is absent, incorrect address).

A requested delivery date shall only be considered to be agreed upon confirmation by Goose AG. Goose AG shall be entitled to make partial deliveries; the customer shall be informed of this in the order confirmation.

 

  1. ONLINE SHOP

The conditions set out in the customer account shall apply for orders in the online shop.

 

  1. DEPOSIT FEES

The following deposit fees shall apply for reusable containers and transport material:

  1. TRANSPORT MATERIAL

Transport material or pallets shall be exchanged 1:1. Any container balances shall be listed on the invoices. Notification of discrepancies must be provided in writing (including by email) within three working days as from receipt. Otherwise, the container balance listed in the invoice shall be considered to be accepted.

 

  1. RETURNS

No returns shall be accepted without written authorisation (including by email) from Goose AG. Goose AG shall provide the return address in writing. Requests for acceptance, by way of an exception, of the return of wines with which there are no problems shall be submitted and justified in writing (including by email) immediately after the delivery has been made. Goose AG reserves the right to reject such requests without giving any reason.

 

  1. INSPECTION AND COMPLAINTS

The customer must inspect the delivery immediately following receipt or upon collection. Obvious transport damage must be recorded immediately on the appropriate delivery documents and Goose AG must also be immediately notified thereof in writing (including by email). Goose AG must be notified of incorrect deliveries/invoices in writing (including by email) within three working days as from receipt of the goods.

 

  1. GUARANTEE AND LIABILITY

Goose AG shall guarantee only those product properties which are expressly assured in the relevant sales documents, all other guarantees are excluded. Any exceptions set out in these T&Cs or in individual agreements remain reserved. Goose AG shall be liable for damages caused intentionally or through gross negligence. All further liability is excluded, to the extent permitted by law.

 

  1. PAYMENT / DEFAULT / RETENTION OF TITLE

Payment must be made within 10 days net as from the invoice date.

For new customers, Goose AG reserves the right to require payment in advance or payment concurrently against delivery. Default interest of 12% p.a. shall be charged in the event of default.

All goods shall remain the property of Goose AG until payment in full. Goose AG shall be entitled to withdraw from the contract and repossess the goods which have been delivered in the event of default by the purchaser. The purchaser must surrender the goods upon the first request. In addition, the default interest shall be owed until surrender/payment. Goose AG reserves the right to assert further claims for compensation.

 

  1. DATA PROTECTION

Goose AG processes data in accordance with the applicable law. More information about the processing of data and data security can be found in Goose AG’s privacy policy.

 

  1. PLACE OF JURISDICTION AND APPLICABLE LAW

Goose AG’s registered office shall be the sole place of jurisdiction.

Swiss law shall apply (to the exclusion of all conflict-of-law rules).
